Thangapandi,C.P.No.1276, PID No.284858 on ordinary leave/emergency leave for 28 days for arranging money and to maintain his ailing mother namely Meenakshi.

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in No.94/Vu.tha.2/2022 dated 30.01.2026 and direct the respondents to release the petitioner's husband namely Dinesh Kumar, S/o. Thangapandi,C.P.No.1276, PID No.284858 on ordinary leave/emergency leave for 28 days for arranging money and to maintain his ailing mother namely Meenakshi.
2. The husband of the petitioner is convicted under NDPS Act in C.C. No.15 of 2021 on the file of the II Additional NDPS Court, Madurai on 01.08.2022 and sentenced to under go ten years rigorous imprisonment and the same was also confirmed by this Court in Crl.A(MD) No.600 of 2022.
3. While being so, the petitioner being the wife of the convict submitted representation seeking emergency leave for her husband since he is languishing in jail for more than four years. However it was rejected on the ground that the convict was convicted under the NDPS Act and as such Rule 21(h)(3) of Tamil Nadu Suspension of Sentence Rules does not permit to grant leave for the convict.
4. Therefore this Court finds no infirmity or illegality in the order passed by the first respondent, hence the petition stands dismissed. However the petitioner is at liberty to file fresh application seeking emergency leave on valid ground. On such representation being filed the authorities concerned are directed to dispose of the same in accordance with law. Consequently connected miscellaneous petition stands closed.
