ORDER: The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406, 417, 420 and 120B of IPC in Crime No.8 of 2025, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant's wife is a B.Ed., graduate and she tried to get government jobs. In the year 2023, December, the defacto complainant and his wife went to a hospital namely Nattathi Nadar Hospital at Theni for body checkup wherein the 3rd accused is working as a Nurse and they have got acquaintance with her.

Further, the 3rd and 4th accused informed that the 1st accused is working as a Doctor at Coimbatore ESIC Hospital and her husband is having big political support and there are vacancies for the post of Clerk and Attender in the said Hospital. The accused persons demanded Rs.8 Lakhs/- for securing the job. On 27.02.2024 to 08.04.2024, the defacto complainant deposited a sum of Rs.6.5 lakhs/- in the bank account of 1st accused. On 27.03.2024, the accused person received a sum of Rs.1,30,000/- as cash from the complainant. Totally, the accused persons received a sum of Rs.7,80,000/- from the complainant and the accused persons informed that they would get the job order within the June 2nd week.

complainant's wife. When they demanded their money, the accused persons returned a sum of Rs.1.5 lakhs/- to the defacto complainant. Thereafter, the accused persons refused to return the balance amount and they came to know that the accused persons have cheated several persons. Further, the accused persons attempted to escape to abroad. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioners. 3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not committed any offence. He seeks this Court to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioners are serious in nature.

5.This Court already directed the petitioners to deposit Rs.6,50,000/-. Today, it is submitted by the learned Counsel appearing for the petitioners that the petitioners have deposited the said amount. The said submission is recorded 3/6

Taking into consideration of the facts and circumstances of the case and since the petitioners have complied with the conditions imposed in the interim anticipatory bail regularly, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate Court, Theni, within a period of fifteen days from the date on which the order copy made ready and on further conditions that: [a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioners shall report before the respondent police daily at 10.30 a.m., until further orders and cooperate with the investigation. [c]the petitioners shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioners shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
