JUDGMENT
(Judgment of the Court was delivered by N.ANAND VENKATESH, J.) This appeal has been filed by the husband challenging the order passed by the family Court, Tirunelveli, in HMOP No.132/2020 dismissing the petition filed seeking for dissolution of the marriage.
2. During the pendency of the appeal, the parties were referred to the Mediation Centre and they were able to arrive at an amicable settlement. The settlement agreement dated 15.04.2026 has been signed by both the parties and their respective counsels. Accordingly the mediation report has been placed before this court along with the settlement agreement.
3. The learned counsel on either side submitted that the appeal can be disposed of in terms of the settlement agreement dated 15.04.2026.
4. The terms of the settlement are extracted hereunder: "6. The following settlement has been arrived at 2/6
between the parties hereto:
A. Both the parties agree to dissolve their marriage held on 28.10.2018 by mutual consent.
B. The respondent hereby consent and no objection to dissolve the marriage by an order of Hon'ble Madurai Bench of Madras High Court in CMA (md) No. 628 of 2023 itself. C. Both the party agree that the minor son namely Srinav continued to be in the care and custody of the respondent (Subbulakshmi). The appellant hereby undertakes that he will not claim the custody of the minor son in future. D. Both the parties handed over the gold ornaments and household articles, which are in their custody to each other. Nothing remains to be handed over to each other. E. The appellant agree to pay a sum of Rs. 10,00,000 (Rupees Ten Lakhs only) towards full and final settlement of permanent alimony to the respondent and minor son namely Srinav. This settlement includes the settlement in Lump sum with regards to payment of monthly maintenance of Rs.
4,000 each te the respondent and their minor son as per the order of the Learned Famil Court, Tirunelveli in MC NO. 13 of 2023. The appellant is not liable to pa any amount in future towards maintenance to the respondent and their minor son. F. The appellant paid the above said Rs.
(Rupees Ten Lakhs only) by way of demand draft for Rs. 10,00,000 drawn in the name of respondent drawn at Axis Bank, K.K Nagar Branch, Madurai District in DD NO. 004950 dated 13.04.2026. The appellant handed over the said Demand draft to the respondent and respondent accepted the same.
G. Both the parties agree to lead their own way of life without the least interference of each other.
7. By signing this Agreement the parties hereto state that they have no further claims or demands against each other with respect to CMA (MD) No. 628 of 2023 and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of mediation."
5. It is clear from the above that the petitioner and the respondent have resolved for dissolving the marriage by mutual consent.
6. In view of the same, the settlement agreement can be treated as mutual consent petition. The six months period is also waived. The marriage between the appellant and the respondent that was solemnized on 4/6
28.10.2018 is hereby dissolved by mutual consent.
7. This Civil Miscellaneous Appeal is allowed in the above terms. No costs.
