Prayer in CRL MP(MD). No.2834 of 2021 :- Criminal Miscellaneous Petition is filed under section 482 of Criminal Procedure Code, praying this Hon'ble Court to relax the condition imposed on the petitioner in Crl.A.(MD) No.375 of 2020 by order dated 09/02/2021.

Criminal Appeal is filed under section 14(A)(2) of the Schedule Casts and Tribes Prevention of Atrocities Act, 1989, as amended by Act 1 of 2016, to call for the records relating to the order dated 01.12.2020 made in Crl.M.P.No.506 OF 2020 on the file of the learned Special Court for Executive Trial of Cases under POCSO Act, Virudhunagar at Srivilliputhur and to set aside the same and enlarge the appellant on bail.

ORDER:- Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.P.Suresh, Advocate for the Petitioner and of Mr.S.Bharathi, Government Advocate On Behalf of the Respondent, this Court made the following order:

The petitioner filed this petition for relaxing the bail condition imposed by this Court on the petitioner in Crl.A.(MD) No.375 of 2020 dated 09.02.2021.

2. The learned counsel for the petitioner submitted that the petitioner is abiding the condition imposed by this Court without any deviation and the investigation was over and charge sheet filed. Hence, he prayed the condition to be relaxed. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. The learned Government Advocate (criminal side) fairly admitted that the petitioner is complying with the condition regularly.

4.In the above circumstances, the condition already imposed on the petitioner is relaxed and the petitioner is directed to appear before the lower Court as and when required by the Court. Accordingly, this petition is allowed.
