ORDER : The Court Made the following order :- The petitioners are apprehending arrest at the hands of the respondent police for the offences punishable under Section 174 of Cr.P.C and subsequently altered into Section 304(b) of IPC in Crime No.104 of 2018, seeks anticipatory bail.

2.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl.Side) appearing for the respondent. This Court heard the learned counsel appearing for the defacto complainant also.

3. In this case, the marriage was performed between the petitioner and the deceased on 11.03.2016. Due to cruelty, she committed suicide by hanging. Hence the husband and in-laws moved petition before this Court seeking anticipatory bail. 4.The first petitioner is said to be suffering from psychiatric issues. The second petitioner is the brother of the husband of the deceased. The third petitioner is the wife of the second petitioner herein. The petitioners 2 and 3 are having a breast feeding baby.

5. Taking into account the nature of the allegations made against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in https://hcservices.ecourts.gov.in/hcservices/

the event of arrest or on their appearance before the learned Judicial Magistrate, Nilakottai, Dindigul District, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
