Heard the learned counsel on either side.
2.The petitioner questions the Form VII that appears to have been taken on file by the first respondent. In such matters, the remedy opens to the aggrieved party is only the jurisdictional Civil Court. Therefore, I am not inclined to admit the writ petition. The writ petition stands dismissed. It is made clear that this writ petition has been dismissed only on the ground of maintainability. The petitioner's right has not been adjudicated. The learned counsel appearing for the writ petitioner states that a civil suit has already been instituted in this regard. Therefore, the Civil Court will decide the issue entirely uninfluenced by the dismissal of this writ petition. No costs. Consequently, connected miscellaneous petitions are closed.
