Respondent Prayer: Criminal Original Petition is filed under Section 439(1) (b) of the Criminal Procedure Code praying to modify the condition imposed by the learned Principal Sessions Judge, Virudhunagar District at Srivilliputur, dated 01.08.2016 in Crl.M.P.No.4305 of 2016 directing the petitioner to appear before the respondent Police once in a week on every Wednesday at 05.00 p.m., until further orders.

ORDER

This petition has been filed praying to modify the condition imposed on the petitioner in the order dated 01.08.2016 passed in Crl.M.P.No.4305 of 2016 by the learned Principal Sessions Judge, Virudhunagar District at Srivilliputur. 2.It is averred in the petition that the petitioner has been arrayed as accused in Crime No.9 of 2016 on the file of the respondent police for the offence punishable under Section 302 IPC. Earlier the petitioner has filed a petition before the learned Principal Sessions Judge, Srivilliputtur in Cr.M.P.No.3946 of 2016 to relax the condition imposed in Crl.M.P.No.2178 of 2016, dated 26.04.2016, to appear before the respondent Police daily at 10.00 a.m., and 05.00 p.m., until further orders and the learned Judge modified the condition to the effect that the petitioner shall appear and sign before the respondent Police on alternative days at 05.00 p.m., until further orders. Principal Sessions Judge, Srivilliputtur in Cr.M.P.No.4305 of 2016 to relax the condition imposed in Cr.M.P.No.3946 of 2016 and the learned Judge modified the condition to the effect that the petitioner shall appear and sign before the respondent Police once in a week on every Wednesday at 05.00 p.m., until further orders. 3.The learned counsel for the petitioner submitted that the petitioner has complied with the earlier condition regularly and therefore, the condition imposed on the petitioner by the learned Principal Sessions Judge, Srivilliputtur, may be modified. 4.The learned Government Advocate (Crl.

Side) submitted that after considering the facts and circumstances of the case, the learned Principal Sessions Judge, Srivilliputtur modified the condition to the effect that the petitioner shall appear before the respondent police once in a week on every Wednesday at 05.00 p.m., until further orders and the petitioner is complying with the condition and the same requires no interference. 5.Considering the above said facts, this Court is inclined to modify the said condition to the effect that the petitioner shall report before the Concerned Court for all future hearings regularly, without fail and the Criminal Original Petition is disposed of accordingly.
