ORDER

This petition has been filed by the petitioner, to call for the records relating to the charge sheet filed in STC No.266 of 2017, on the file of the learned Judicial Magistrate, Alangulam and quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.

3. As per definition of Sections 2 & 3 of the Tamil Nadu City Police Act (Extension to the City of Tirunelveli), the scene of occurrence will not fall within the Tirunelveli City Corporation and necessarily the Act will not apply and hence, case has to be quashed.

4. This Criminal Original Petition is allowed and the proceedings in S.T.C. No. 266 of 2017, on the file of the learned Judicial Magistrate, Alangulam is hereby quashed.
