Contemnors/Respondents PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, to punish the Contemnors/ Respondents for willfully disobeying and not complying with the order passed by this Court in W.P(MD)No.18064 of 2013, dated 23.01.2020.

ORDER

This is a petition seeking initiation of contempt proceedings against the Respondents for violation of the order, dated 23.01.2020 passed by the Writ Court in W.P.(MD)No.18064 of 2013. 2.Heard Mr.K.M.Mohammed Ali, learned counsel appearing for the Petitioner and Mr.F.Deepak, learned Special Government Pleader who accepts notice on behalf of the Respondents. Therefore, no further notice is required to be issued to the Respondents.

The Contempt Petition has been filed for non compliance of the judgment and order passed by the Writ Court in W.P.(MD)No.18064 of 2013 dated 23.01.2020 and the learned Single Judge of this Court allowed the said Writ Petition in the following terms: "7. Accordingly, the impugned order of punishment imposed by the third respondent herein in PR No.55/2010 dated 21.06.2011, confirmed by order of the second respondent in AP No.16 of 2011 dated 16.08.2011 and finally rejecting the Review Petition by the third respondent by order in Na.Ka.No.A4/6877/2012 dated 17.05.2012 are hereby quashed and the respondents are directed to reinstate the petitioner as Havildar with all backwages and attendant benefits accrued to his service with revision of pay scale in the salary. The said exercise shall be completed within 12 weeks from the date of receipt of a copy of this order.

8. With the above directions, the writ petition is allowed. No costs. Consequently, connected Miscellaneous Petition is closed."

Today, when the matter is being taken up, Mr.F.Deepak, learned Special Government Pleader for the Respondents, produced an order dated 19.03.2025, passed by the Commandant, TSP IX Battalion, Manimuthar and submits that the Respondents have complied with the order of the Writ Court dated 23.01.2020 passed in W.P.(MD)No.18064 of 2013. A copy of the said order has been taken on record and the same has already been furnished to the learned counsel for the Petitioner. Therefore, he prays that the Respondents may be discharged from the contempt proceedings. 5.Mr.K.M.Mohammed Ali , learned counsel for the Petitioner submits that he has received a copy of the order dated 19.03.2025 and submits that the direction issued by the Writ Court vide judgment and order dated 23.01.2020 passed in W.P.(MD)No.18064 of 2013 has been fully complied with. He further states that he has no objection to the Respondents being discharged from the contempt proceedings.

Considering the submissions made by the learned counsel for the Petitioner and the learned Special Government Pleader for the Respondents, and upon perusal of the order dated 19.03.2025 passed by the Commandant, TSP IX Battalion, Manimuthar, this Court is satisfied that the Respondents have fully complied with the judgment and order of the Writ Court dated 23.01.2020 passed in W.P.(MD)No.18064 of 2013. In view of the same, this Court deems it appropriate that no useful purpose would be served by keeping the contempt proceedings pending. Therefore, the Respondents are discharged from the contempt proceedings.
