ORDER

This Criminal Original Petition has been filed by the petitioner to transfer the investigation in Crime No.296 of 2023 from the file of the fourth respondent to the third respondent.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the defacto complainant in this case and based on the complaint given by him a case has been registered in Crime No. 296 of 2023 for the offence under Section 174 of Cr.P.C., Thereafter they have not conducted proper investigation and the same is pending without any progress, therefore he has filed the present petition.

The learned Government Advocate(Crl.Side) appearing for the respondents would submit that based on the complaint given by the petitioner a case has been registered in Crime No. 296 of 2023 for the offence under Section 174 of Cr.P.C., and thereafter the fourth respondent investigated the case and now the first respondent transferred the case 2/5

from the file of the fourth respondent to Assistant Superintendent of Police, Colachel Sub Division through proceedings No.C.No.C1/ 4804/ 2023 dated 25.01.2025.

4. Since the investigation of the case was entrusted to some other person no further order is required to be passed in this petition.
