RESPONDENT/RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition No.6 imposed by this Honble Court in Crl.OP.No.5229 of 2022 dt.23.3.2022 and pass such further or other orders as this Honble Court.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KARUNANITHI.M, Advocate for the petitioner and of Mr.M.MUTHUMANIKKAM, Government Advocate(crl.side) on behalf of the Respondent, the Court made the following order:- This petition has been filed seeking orders to modify the conditions imposed by this Court in Crl.O.P.(MD)No.5229 of 2022, dated 23.03.2022, wherein, this Court has directed the petitioner to deposit a sum of Rs.50,000/- to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai-9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172), without prejudice to his rights and contentions before the trial Court and produce the receipt/acknowledgment before the learned Judicial Magistrate No.I, Virudhunagar District.

2.The learned counsel for the petitioner would submit that since the petitioner is in custody, his family members could not gather funds, that though this Court has granted bail on 23.03.2022, he has not produced the sureties for want of funds to deposit the amount as directed by this Court and that the petitioner is ready and willing to deposit a sum of Rs.25,000/- at the beginging and after coming out on bail, he will pay the remaining amount of Rs.25,000/- within two weeks.

3.The learned Government Advocate (Criminal Side) appearing for the State, has not raised any objections for allowing the said petition.

CRL MP(MD) No.4466 of 2022 4.Considering the facts and circumstanes of the case and also considering the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the condition and the petitioner is directed to pay a sum of Rs.25,000/- to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172), and after coming out on bail, he is directed to pay the remaining amount of Rs.25,000/- to the same account within a period of two weeks. 5.With the above modification, this petition is disposed of. sd/- 08/04/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
