respondent in No.1626/Tha.ku.4/ 2026 dated 11.02.2026 and quash the same and consequently direct the respondents 2 and 3 to grant six days emergency leave without escort to the petitioner's brother namely Satheehkumar, S/o.Murugesan, PID No.280707 now confined under Central Prison, Madurai. O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the second respondent in No.1626/Tha.ku.4/ 2026 dated 11.02.2026 and direct the respondents 2 and 3 to grant six days emergency leave without escort to the petitioner's brother namely Satheehkumar, S/o.Murugesan, PID No.280707 now confined under Central Prison, Madurai.

It is the case of the petitioner that his brother was convicted by the learned Sessions Judge, Mahila Court, Trichy in Spl.S.C.No.115 of 2020 and sentenced to undergo twenty years rigorous imprisonment on 20.05.2022, Against which the convict has preferred an appeal before this Court in Crl.A(MD) No.448 of 2022 and the same was dismissed by this Court. Aggrieved over the same, the convict has also preferred an appeal before the

Hon'ble Supreme Court in SLP(Crl.) No.16814 of 2024 and the same was dismissed on 02.12.2024. The convict is in imprisonment for more than 20 years. While being so, the petitioner being sister of the convict submitted representation seeking six days emergency leave to the convict, however it was rejected by the authorities concerned.

3. Considering the facts and circumstances of the case, this Court is inclined to grant three days emergency leave to the convict without escort.

4. Accordingly, the impugned order passed by the second respondent is set aside and writ petition is disposed of with the following directions: (i) The respondents are directed to grant three days emergency leave without escort to the convict prisoner namely, Satheehkumar, S/o.Murugesan, PID No. 280707 now confined under Central Prison, Madurai. from 02.03.2026 to 04.03.2026. The convict prisoner shall be released from the prison on 02.03.2026 at 6.00 am., (ii) He shall report back to the Superintendent of Prison, Central Jail, Trichy / second respondent, by 04.03.2026

at 6.00pm.., (iii) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities, (iv) The convict shall report before the fifth respondent daily at 5.30 pm., till the completion of leave period. (v) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
