Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents, particularly the 5th Respondent, to remove the illegal encroachment allegedly made by the 6th Respondent over the Government classified Agricultural Cart Track situated in Survey No. 184/1 at Sethur Village (Soriparaipatti), Natham Taluk, Dindigul District, by considering the villagers' representation dated 02.04.2025 and the petitioner's representation dated 07.02.2026 within a time frame to be fixed by this Court.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks a direction to the fifth respondent to remove the encroachment made by the sixth respondent.

2. According to the petitioner, the sixth respondent is an adjacent landowner and he has encroached upon the cart track. However, no action has been taken despite his representation. 2/5

3. The learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, submits that already proceedings under the Tamil Nadu Land Encroachment Act were initiated against the sixth respondent and they will proceed as per law.

4. In such view of the matter, we are of the view that the respondents shall proceed as per law after giving proper opportunity to the sixth respondent.

5. With the said observations, this Writ Petition is disposed of. No costs.
