ORDER

It is a petition seeking a direction to the respondent not to harass the petitioner under the guise of enquiry.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).

3. The learned counsel for the petitioner would submit that the 1st defendant has executed a sale agreement in favour of the petitioner in respect of the share allotted to the 1st defendant in accordance with the preliminary decree in O.S.No.510/1970 and in the said suit, an application for final decree is pending. It appears that the de-facto complainant, who is the 33rd defendant in the suit, aggrieved over the sale agreement, preferred the false complaint, over which, the respondent has no jurisdiction.

4. The learned Government Advocate (Crl. Side), on instructions, would submit that a suit is pending, in which, the civil Court has got jurisdiction to decide and the respondent has no interest in the civil dispute between the parties. Therefore, there is no opportunity for the respondents to harass the petitioner.
