PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 294(b), 406 and 506(1) I.P.C, and Section 4 of Tamil Nadu Prohibition of Woman Harassment Act, in Crime No.5 of 2018, seek anticipatory bail.
2.Heard the learned counsel appearing for the petitioners and also the learned counsel appearing for the defacto complainant / intervenor.
3.The petitioners herein in order to procure relief from this Court have given an undertaking that they will deposit a sum of Rs.6,000/-(Rupees Six Thousand Only) in the back account of the defacto complainant on or before 10th of every month for a period of two years.
4.The learned counsel appearing for the defacto complainant is directed to furnish the bank account details of the defacto complainant. If this undertaking is breached, the defacto https://hcservices.ecourts.gov.in/hcservices/
complainant is entitled to move this Court seeking cancellation of this order.
5.Recording this undertaking and subject to this condition, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate Court No.1, Thoothukudi, Thoothukudi District, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
