No.4458/E1/2022 and quash the same.

ORDER

The present Writ Petition has been filed to quash the impugned order of the 1st respondent dated 09.01.2024 in No.19383/U4/2023 confirming the order passed by the 2nd respondent dated 17.04.2023 in Muu.Mu. No.4458/E1/2022. 2.The impugned order was passed based on the complaint submitted by the 4th respondent. The present impugned order was passed under Section 77-A of the Registration Act. The first respondent has no power to pass such order, since Section 77-A was also struck down by the Honourable Division Bench of this Court. Therefore, the impugned order is liable to be quashed. 3.Accordingly, this writ petition is disposed of. The impugned order of the 1st respondent dated 09.01.2024 in No.19383/U4/2023 confirming the order passed by the 2nd respondent dated 17.04.2023 in Muu.Mu. No.4458/E1/2022, is hereby quashed.

The 4th respondent is at liberty to file a civil suit if so advised. Since the 4th respondent has challenged the partition, this court is not inclined to grant any interim protection. There shall be no order as to costs. Consequently, the connected writ miscellaneous petitions are closed. 29.08.
