Respondents Habeas Corpus Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus to direct the 1st and 2nd respondents to produce the body or person of the petitioner's minor daughter namely, Sindhuja D/o.Alaguraj aged about 17 years from the illegal detention of the third respondent before this Court and hand over to the petitioner's custody. ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the mother of one Sindhuja, who is aged 17 years. On the allegation that she is found missing, the petitioner has come up with this petition.

2. Today, when the matter was taken up, the 2nd respondent has produced the detenue, viz., Ms.Sindhuja. Her date of birth is 16.06.1998. Thus, she has not completed 18 years of age. When enquired, she has stated that she would go with her mother. The said statement is recorded.

3. The learned Additional Public Prosecutor would submit that in connection with the above occurrence, a case has been registered in Crime No.24 of 2015 under Section 366A IPC, in which, the third respondent has been arrested and remanded to judicial custody and the investigation is going on.

4. In view of the above, the Habeas Corpus Petition is disposed of entrusting the custody of Ms.Sindhuja, to the petitioner, until she attains her majority.
