Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 1st Respondent to take a call by issuing notice to the Co-Pattadhars and issue separate Patta in connection with Survey No.240/3 at Chidambaram Chettiyar Line, Ponnamaravathi, Pudukkottai District in the light of registered Will Deed dated 14.03.2007 vide Document No. 10 of 2007 by considering the Petitioner's Representation dated 12.02.2026 in the light of the E-Challan No.20260212019473 within time as fixed by this Court. 1/5

O R D E R

This Writ Petition has been filed to direct the 1st respondent to demarcate and issue individual patta to the petitioner based on the representation dated 12.02.2026.

The learned counsel for the petitioner submitted that the petitioner has rights over the property in Survey No. 240/3 through Will which was executed by the petitioner's mother under Document No. 10 of 2007 dated 14.03.2007. Subsequently, the petitioner's mother died on 02.11.2022 and thereafter, the Will has come into effect. Hence, the petitioner seeks demarcation of the property and issuance of an individual patta.

3. Heard the learned Additional Government Pleader appearing for the 1st respondent.

Considering that the petitioner claims rights over the property based on a Will, and in the absence of any pending civil suit, he is entitled to have the property surveyed, demarcated, and to obtain an individual patta. Accordingly, this Court directs the first respondent to conduct an enquiry after issuing notice to the petitioner and respondents 2 to 7. However, the 1st respondent shall not insist for registration of Will, since the same is not mandatory. If the respondents 2 to 7 are disputing the Will, the parties may be directed to approach the competent Civil Court.

5. The enquiry shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
