Respondents PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to direct the first respondent to instruct the respondents No.2 and 3 not to interfere in the civil dispute by unnecessarily harassing the petitioner and his family members illegally under the guise of enquiry.

ORDER

The petitioner alleges harassment at the hands of the respondent police.

2.The learned Government Advocate (Crl.side) states that an allegation regarding fabrication of documents has been received and it is pending at the enquiry stage. FIR is yet to be registered. 3.In these circumstances, I am of the view that interest of justice will be served by issuing the following directions:- (I) The second respondent/third respondent will issue summons in writing, if he wants to enquire the petitioner. There cannot be any oral summon for attending enquiry.

(II) If the second respondent/third respondent registers any FIR, the petitioner will be given due notice, so that, the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.5650 of 2020 petitioner will have breathing time to move the concerned Court for the relief of anticipatory bail.

4.With this direction, this Criminal Original Petition is disposed of.
