For Respondent : Mr.S.Chandrasekar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.64 of 2020 on the file of the respondent police ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 380 of IPC seeks anticipatory bail.
2.The petitioner here is working as a steno in Judicial Magistrate Court, Mudukulathur. Based on the complaint given by an advocate that her bag is missing and stolen by somebody, CCTV footage was viewed and found that the petitioner has handled the said hand bag.
3. According to the petitioner she found the bag unclaimed. She took it and handed it over to the Judicial Magistrate and she https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.5241 of 2020 never had the intention to take the bag or commit the theft. However since the First Information Report has been registered in Crime No.64 of 2020 on the file of the respondent police and the same being investigated, she apprehends arrest. Hence the present petition is filed for anticipatory bail.
4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor through video conference.
5. Considering the nature of the complaint and the statement made by the petitioner, this Court finds that the petitioner being a steno working in the Judicial Magistrate Court, the explanation given for handling the unclaimed bag appears to be acceptable . Hence, this Court is inclined to grant anticipatory bail to the petitioner subject to the following conditions: i)Considering her position and Covid-19 pandemic situation in case of arrest the petitioner shall be released on bail on obtaining bond for Rs.25,000/-.
ii) The petitioner shall report before the respondent police as and when required for interrogation.
