Criminal Original Petition under Section 482 of Criminal Procedure Praying this Hon`ble Court to pass an order directing the Learned Chief Judicial Magistrate, Nagercoil , Kanyakumari District to expedite the trial in Spl. Case No.5 of 2015. ORDER:

This Petition coming on for hearing on this day, upon perusing the earlier order of this Court and the requisition letter submitted by Chief Judicial Magistrate, Kanyakumari at Nagercoil vide the letter in D.No.3665/2017 dated 06.10.2017 and on appearance of Mr.S.PALANIVELAYUTHAM, Advocate for the Petitioner, and of Mr.C.MAYIL VAHANA RAJENDRAN, Additional Public Prosecutor, on behalf of the Respondent, this Court made the following Order: The learned counsel for the petitioner is absent and the learned Additional Public Prosecutor appearing for the respondent is present.

2.A report dated 06.10.2017 received from the Chief Judicial https://hcservices.ecourts.gov.in/hcservices/ Magistrate concerned reveals the fact that so far 9 witnesses were examined out of 30 witnesses and prosecution exhibits were marked

and three defence documents were marked and now the case is adjourned to 07.12.2017 for examination of L.Ws.7, 13 and 15. 3.Considering the status report filed by the prosecution and also the report submitted for first extension by the Court concerned, for disposal of the case in Special Case No.5 of 2015, six months further time is granted from the date of receipt of the order copy by the learned Chief Judicial Magistrate, Kanyakumari District at Nagercoil. He is also directed to report the same to the Registry.
