ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.C.DEEPAK for Mr.S.VINODH, Advocate for the petitioners and of M/S.K.SUDALAYANDI, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed by the petitioners / claimants to withdraw the entire award amount, which was deposited into the credit of MCOP.No.22 of 2019 on the file of the Motor Accidents Claims Tribunal / Additional District Judge / FTC, Theni.
2. The learned counsel appearing for appellant / Transport corporation would submit that he has no objection to withdraw the admitted liability of Rs.11,69,400/-.
3. Considering the above, the petitioners / claimants are permitted to withdraw the said sum of Rs.11,69,400/- (Rupees Eleven Lakhs Sixty Nine Thousand and Four Hundred only), which was lying in the credit of MCOP.No.22 of 2019, together with proportionate https://hcservices.ecourts.gov.in/hcservices/
interest, as per the apportionment fixed by the Tribunal, on filing necessary application before the Tribunal.
4. The petition is ordered accordingly.
