ORDER : The Court Made the following order :- Petitioner who is arrayed as accused prays for grant of anticipatory bail under Section 438 of Cr.P.C. for offences punishable under Section 498(A) of IPC in Crime No.not known of 2016 on the file of respondent police.
2. The case of the prosecution is that the petitioner along with other accused tortured the defacto complainant both mentally and cruelly on demanding additional dowry.
3. The learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and her name has been falsely implicated in this case.
4. Learned Government Advocate (Crl. Side) submits that now, case has been registered in Crime No.21 of 2016 for the offences under Sections 498(A), 294(b) of IPC and Section 4 of Prohibition of Harassment of Women Act and the investigation is pending.
5. On consideration of the facts and circumstances of the case and the submissions made, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly; (a) In the event of arrest by or on appearance before the respondent police;
(b) In the event of appearance before the learned (*)Judicial Magistrate No.III, Nagercoil, Kanyakumari District; within 15 days from the date of receipt of a copy of this order, https://hcservices.ecourts.gov.in/hcservices/
(i) Petitioner shall be enlarged on bail on executing a bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to his satisfaction;
(ii) The petitioner shall be available for interrogation daily at 10.30 am for a period of two weeks and thereafter, as and when required.
