ORDER
This writ petition has been filed for a Mandamus seeking for a direction to the respondent to correct the name of the petitioner's wife as Mages instead of Maheswari, in her death certificate, based on the petitioner's representation dated 23.03.2022. 2.According to the petitioner, his wife died on 20.11.2019 and her death certificate was also issued by the respondent. According to him, the name of his wife in the death certificate has been wrongly mentioned as Maheswari, though the correct name is Mages. In such circumstances, the petitioner has given a representation referred to supra to the respondent, calling upon him to correct the name of his wife in her death certificate. Since the said representation has not been considered till date, this writ petition has been filed.
3.Heard Mr.R.Anand, learned Counsel for the writ petitioner and Mr.B.Saravanan, learned Additional Government Pleader, who accepts notice on behalf of the respondent.
4.The petitioner has filed all the relevant documents in support of his case that the correct name of his wife is Mages and not Maheswari as disclosed in her death certificate. It is for the respondent to consider the same on merits and in accordance with https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.[MD]No.7166 of 2022 law. The petitioner has also given a representation on 23.03.2022 to the respondent calling upon him to correct the name of the petitioner's wife.
5.No prejudice would be caused to the respondent, if the representation of the petitioner is considered on merits and in accordance with law, after hearing the petitioner. 6.For the foregoing reasons, this Court directs the respondent to consider the petitioner's representation dated 23.03.2022 requesting the respondent to correct the name of his wife as Mages instead Maheswari as found in her death certificate and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner, within a period of eight [8] weeks from the date of receipt of a copy of this order.
7.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
