ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 308(5) of BNS, in Crime No. 564 of 2025, on the file of the respondent police, seeks anticipatory bail.

According to the prosecution, on 23.10.2025 at about 09.35 p.m, the petitioner and two other persons are said to have committed the extortion of Rs.10,000/- from the defacto complainant, who is the B.E graduate and is working in a private company. Hence, the respondent police registered a case for the aforesaid offences. Hence, this petition. A1 was already arrested and thereafter, released on bail.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent persons and he has not committed any offences as alleged by the prosecution. He further submitted that A1 was already arrested and thereafter, released on bail and 2/5

no previous case is pending against the petitioner herein. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) on instructions, submitted that there is no previous case against the petitioner. But, the allegation against the accused is that they extorted money from the defacto complainant during night hours and invited him for sexual pleasure. Hence, he prayed for dismissal of this petition.

5. This Court considered the rival submissions.

6. Even though, A1 was arrested and released on bail and no previous case against the petitioner, considering the nature of the allegation that extortion of money from the defacto complainant during night hours, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original petition stands dismissed.
