ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.Rajan, Advocate for the Petitioner and of Mr.B.Nambi Selvan, Additional Public Prosecutor for the Respondent, this Court made the following order:- This Criminal Miscellaneous Petition is filed to restore the order, made in Crl.OP(MD)No.9854 of 2021.
2. The main petition in Crl.OP(MD)No.9854 of 2021 was dismissed for default, on 02.11.2021, due to the non appearance of the learned counsel for the petitioner.
3. This petition came to be filed mainly on the ground that on the date of hearing, the learned counsel for the petitioner was not https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD)No.4765 of 2022 in a position to appear through video conference because of some inconvenience.
4.The learned Additional Public Prosecutor has no objection to allow this petition.
5. On the basis of the above said ground, this Criminal Miscellaneous Petition is allowed.
