Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle a sum of Rs.15,950/- towards the payment of Post Retirement Benefits Scheme amount, together with interest at the rate of 6% p.a payable to the petitioner from the date of his retirement i.e. 30.06.2016 and all other attendant benefits to him within the stipulated period.

ORDER

The limited prayer sought for in the present Writ Petition is for disbursal of sum of Rs.15,950/- towards Post Retirement Benefits Scheme as well as for interest on the belated payment of the benefits.

2. When the petitioner herein had made an application under the Right to Information Act for details of his entitlement for the Post Retirement Benefits Scheme, the second respondent herein, through an order dated 16.12.2020, had replied stating that the petitioner is entitled for a sum of Rs.15,950/- till 30.06.2016. Admittedly, the aforesaid sum has not been paid to the petitioner at the time of his retirement on 30.06.2016.

3. In the light of the information supplied by the second respondent herein, there shall be a direction to the second respondent to consider the petitioner's representation dated https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.7422 of 2021 26.11.2020 within a period of eight (8) weeks from the date of receipt of a copy of this order and disburse the said amount of Rs.15,950/- together with interest at the rate of 6% from the date on which the amount is due to the petitioner herein.

4. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
