Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the 1st respondent to renew the petitioner passport in respect of the petitioner application in file No.MD2075357172725 dated 18.07.2025 within a stipulated time prescribed by this Court.

ORDER
This writ petition is filed for a mandamus directing the first respondent to renew the petitioner's passport in file No.MD2075357172725 dated 18.07.2025.
2.When the matter came up for hearing, the learned counsel taking notice on behalf of the first respondent would submit that a criminal case is pending.
3.The Learned Government Advocate appearing for the respondents 2 and 3 would submit that a criminal case was registered against the petitioner in Crime No.528 of 2025 for the alleged offence under Sections 294(b), 342, 323, 324, 326 and 506(ii) IPC. After the completion of investigation, charge sheet has also been filed and the same is pending before the learned Judicial Magistrate No.III, Nagercoil, in C.C.No.99 of 2017. 4.In view thereof, even if charge sheet is pending, there is no impediment to the renewal of the passport. However, the petitioner shall file an application before the concerned Court before leaving abroad.
5.In view thereof, this Writ Petition is ordered on the following terms: (i)The first respondent is directed to further process of the application of the petitioner in file No.MD2075357172725 dated 18.07.2025 and renew the passport.
(ii)The petitioner shall obtain appropriate permission from the learned Judicial Magistrate No.III, Nagercoil, before proceeding abroad. 17.03.2026 NCC:Yes/No Ns To 1.The Superintendent of Police, District Police Officer, Kanyakumari District.
