Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the 2nd respondent to issue patta in the name of the petitioner for the lands comprised in Survey Nos.336/3 (0.21.86 Hectares), 337/1B2 (0.17.00 Hectare), 343/2 (0.64.00 Hectares), 344/1 (0.35.00 Hectares) and 346/2 (0.41.00 Hectares) situated at Kalapakkulam Village, Sankaran Kovil Taluk, Tenkasi District based on the petitioner's representation dated 19.01.2026 within a specified time frame.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to issue patta in the name of the petitioner for the lands comprised in Survey Nos.336/3 (0.21.86 Hectares), 337/1B2 (0.17.00 Hectare), 343/2
(0.64.00 Hectares), 344/1 (0.35.00 Hectares) and 346/2 (0.41.00 Hectares) situated at Kalapakkulam Village, Sankaran Kovil Taluk, Tenkasi District based on the petitioner's representation dated 19.01.2026 within a specified time frame. 2.The petitioner had purchased the land as early as 2019 through sale deeds Document Nos. 271 and 1351 of 2019. After purchasing, the petitioner sought to survey and demarcate the property. The same was rejected. The petitioner approached this Court in W.P. (MD)No.13598 of 2021. This Court vide order dated 05.04.2024 directed the respondents to issue notice to petitioner and the interested parties and pass orders within a period of 12 weeks.
3.The respondent has measured the land as per the order of the Court. Thereafter, the petitioner sought separate patta to the petitioner's land and the same was rejected. Aggrieved over the same, the petitioner preferred appeal before the first respondent and the same was allowed and the matter was remitted back to the Tahsildar to conduct an enquiry and pass a speaking order. But the said remitted case is still pending with the second respondent Tahsildar. Hence, the petitioner has filed the present writ petition.
4.The second respondent shall conduct an enquiry after issuing notice to the petitioner and the rival claimants if any and pass appropriate orders in accordance to
law on or before 30.04.2026.
5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
