PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records relating to the 3rd respondent in his proceedings RC NO.080210/C3/S3/2025, dated 09.02.2026 and quash the same as illegal and direct the respondents to reinstate the petitioner as BT Assistant (Maths) in Government Higher Secondary, Sooriyur.

The impugned proceedings dated 09.02.2026 has been issued by the third respondent consequent upon the conviction suffered by the petitioner in C.C.No.82 of 2013, on the file of the Judicial Magistrate Court No.II, Virudhunagar. Though the petitioner claimed to have filed a criminal appeal against the said conviction in Criminal Appeal No.222 of 2025, on the file of the Principal District and Sessions Court, Virudhunagar District at Srivilliputtur, the conviction imposed on the petitioner is not suspended. In

view of the same, there is nothing to find fault with the impugned proceedings. Hence, this writ petition is dismissed. However, it is made clear that in case the petitioner succeeds in the criminal appeal and the conviction imposed on him is set aside, it is open for him to approach this Court seeking the similar relief. No costs. Consequently, connected miscellaneous petition is closed. 10.03.2026 NCC :
