Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to issue renewal of the petitioner's passport in file No.MD01C5086934318 dated 19.11.2018 as per the directives issued in notification in GSR 570-(E) dated 25.08.1993 by the first respondent.

The Inspector of Police, Anti Land Grabbing Cell, Nagercoil and the Inspector of Police, Kottar police station, Kanyakumari District, are suo motu impleaded as respondents 3 and 4. Mr.M.Murugan, learned Government Advocate takes notice for respondents 3 and 4.

2. Heard the learned counsel on either side.
3. The Writ petitioner had applied for issuance of renewal of passport. It appears that two criminal cases are pending against the Writ petitioner on the file of respondents 3 and 4. Respondents 3 and 4 are directed to send a report to the second respondent within a period of two weeks from the date of receipt of a copy of this order. The reports of respondents 3 and 4 should indicate as to whether the final reports filed by them have been taken on file by the Courts concerned and whether the case numbers have been assigned. If the reports of the police indicates such case numbers, then the petitioner will have to move the jurisdictional civil Court for getting permission to travel abroad. If no case numbers have been assigned and the final reports filed by the police have not been taken on file, the second respondent shall renew the petitioner's passport within a period of three months thereafter, subject to fulfillment of other formalities.
4. The Writ petition stands disposed of, on these terms. No costs.
