The petitioner, an accused in Spl.Case.No.8 of 2015, on the file of the Special Court for Prevention of Corruption Act Cases/Chief Judicial Magistrate Court, Thanjavur at Kumbakonam was found guilty by the trial Court and was convicted 1/3

13(2) r/w 13 (1)(d) of Prevention of Corruption Act 1 year Rigorous Imprisonment Rs.2,000/- 2 months simple imprisonment 2.

As against the conviction and sentence imposed by the trial Court in Spl.Case No.8 of 2015, dated 06.02.2025, the petitioner has filed a Criminal Appeal in Crl.A(MD) No.311 of 2025 and the same is admitted by this Court today. The petitioner has also moved this application to suspend the sentence imposed on her by the trial Court. 2.The trial Court, while convicting the petitioner has also suspended the sentence under Section 389(3) of Cr.P.C, for a period of one month and that period was over as on 06.03.2025. After the said period, the petitioner has moved this petition for suspension of sentence only on 12.03.2025. The petitioner has failed to surrender on 07.03.2025, on completion of the interim suspension period. 2/3

3.Therefore, this Court is not inclined to entertain this petition. Accordingly, this Miscellaneous Petition is dismissed.
