Respondents Prayer: Writ Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to conduct Pooja and worship the deity in "Sri Anjaneyar Kovil" situated in Aganthapatti Village, Kallikudi Post & Taluk, Madurai District, in lieu of "Chithirai" festival scheduled to be conducted on 14.04.2019.

ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for the respondents 1 to 4.

2. This writ petition pertains to performance of Chithirai festival by performing pooja in the petition mentioned temple on 14.04.2019.

3. It appears that there are two groups in the village and therefore, the Revenue Authorities have advised that no festival

will be celebrated.

4. The learned counsel appearing for the writ petitioner states that the petitioner is not insisting of any conferment of first honour. It is also stated that there is a common poojari.

5. Therefore, the second respondent is directed to ensure that the pooja is conducted by the common poojari on 1st of Tamil month of "Chithirai". It is made clear that this Court has not pronounced anything on the rights of any person. Since there is no time left for issuing notice to the fifth respondent, notice to the fifth respondent is dispensed with.

6. It is also made clear that this Court has not pronounced anything adverse to the interest of the fifth respondent. All that, this Court directs that on Chithirai 1st, the temple should not be closed. Pooja only should be performed as directed by this Court.

7. With the above direction, this writ petition is disposed of. No costs.
