ORDER : The Court Made the following order :- The petitioner is arrayed as the second accused, who was arrested and remanded to judicial custody on 24.01.2020 for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(c), 25 of NDPS Act in Crime No.41 of 2018, on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the petitioner was having possession of 30 kgs of Kanja.

3.The learned counsel for the petitioner would submit that the petitioner has been in judicial custody from 24.01.2020 and he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that due to non appearance of the petitioner, case was split up and even thereafter, the petitioner has not appeared before the Court and therefore, Non Bailable Warrant was issued. If the petitioner comes out on bail, he would abscond and the trial could not be completed. 5.I have heard both sides and perused the records. https://hcservices.ecourts.gov.in/hcservices/ 1/2

It is seen that after completion of investigation, charge sheet has been filed and and the same has been taken on file in C.C.No.16 of 2018 and subsequently, the petitioner has not appeared before the court and therefore the case was split up and now, the petitioner is facing trail before the Principal District and Sessions Court for EC and NDPS Act Cases, Madurai in C.C.No.280 of 2019. Due to non appearance of the petitioner, Non Bailable Warrant was issued against the petitioner and the petitioner has not surrendered and except the Investigation Officer, all the witnesses were examined. Earlier bail applications were dismissed with a direction to complete the trial within a stipulated time.

7. Considering the above facts and circumstances of the case and serious nature of offence and stage of the case, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this petition is dismissed.
