Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, by calling for the records pertaining to the impugned transfer order passed by the second respondent in D.O.No.112/2020, C.No.A1/2872/2020 dated 03.2020, signed on 24.03.2020 and the consequential relieving order passed by the 4th respondent in Nil dated 25.03.2020 and to quash the same and direct the respondents to confer all consequential benefits on the petitioner. ORDER
Heard the learned Counsel for the petitioner and the learned Special Government Pleader appearing for the respondents. 2.The petitioner has been transferred from Tirunelveli to Chennai, Egmore Railway Police Station. The petitioner, who is working as a Head Constable in Tirunelveli Railway Police Station, has now been asked to join at Egmore Railway Police Station in the same post.
3.Since it is an issue of transfer and an administrative order, it may not be proper on the part of this Court to examine either reasons for transfer or also the grievances of the petitioner. It is for the authorities to examine the same. The https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)Nos.6127 of 2020 grievance of the petitioner is that he has been relieved from Tirunelveli with a direction to join at Chennai. But, he has still not joined at Chennai.
4.In view of the circumstances, particularly of the Covid-19 Pandamic, wherein movement is practically impossible, particularly from the southern part of the State to Chennai, the most northern part of the State, a relief is granted to the petitioner to join at Chennai Egmore Railway Police Station on or before 11.05.2020. The petitioner at the time of joining at Chennai may give a representation giving necessary reasons for not joining immediately after being relieved at Tirunelveli. The authorities may consider the said representation. The period from the date on which the petitioner was relieved at Tirunelveli till the date of the petitioner joining at Chennai may, if it is permissible, also be considered as on duty and necessary benefits may be granted to the petitioner. If the authorities have any objections, then the same must be given in writing to the petitioner and the petitioner may also question and challenge the same by initiating appropriate proceedings.
5.With the above directions, this writ petition is disposed of. However, it is made clear that the petitioner should join at Chennai, Egmore Railway Police Station on or before 11.05.2020. Consequently, connected miscellaneous petition is closed. No costs.
