Prayer: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent not to harass the petitioner and her family members, under the guise of an enquiry.

ORDER

The main grievance of the petitioner is that though the third respondent already lodged a complaint with the Inspector of Police, Pudur Police Station, Madurai, she had lodged another complaint before the second respondent / Inspector of Police, Tallakulam All Women Police Station, Madurai, and based on the said complaint, the second respondent is harassing the petitioner. 2.Mr.A.Robinson, learned Government Advocate (Criminal side), who accepts notice on behalf of the respondents 1 and 2, on instructions, would contend that this is a case of matrimonial dispute and that the complaint lodged with the Inspector of Police, Pudur Police Station, Madurai, by the third respondent is with regard to some other occurrence and the Inspector of Police, Tallakulam All Women Police Station, Madurai, received a complaint from the third respondent against the present petitioner and the same was registered in CSR No.192 of 2021 and posted for enquiry. https://hcservices.ecourts.gov.in/hcservices/ 1/

Crl.O.P.(MD)No.4889 of 2021 3.Recording the submission of the learned Government Advocate (Criminal Side), this Criminal Original Petition is disposed of with a direction to the second respondent to follow the guidelines issued in the decision in D.K.Basu Vs. State of West Bengal reported in AIR (1997) SC 610 and Lalita kumari vs. Government of Uttarpradesh and Others reported in AIR 2014 SC 187.
