RESPONDENTS IN WP(MD)No.9191,9199,9220,9235,9240, 9369,9372, of 2019 COMMON PRAYER: Writ Petitions is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus directing the respondents to issue an equivalence certificate to the effect that M.Sc (Computer Science & Information Technology) Course is equivalent to Masters Degree in Computer Science or Information Technology for the purpose of employment in Direct recruitment for post of Computer Instructors Grade-I (Post Graduate Cadre) called for by 1st respondent in Notification No.9 of 2019 dated 01/03/2019.

Graduate Cadre) called for by the first respondent vide Notification No.9 of 2019, dated 01.03.2019.

2.The learned Counsel for the petitioners submitted that the petitioners possess M.Sc., (Computer Science and Information Technology). The first respondent has issued notification calling for applications to fill up the post of Computer Instructors Grade-I (Post Graduate Cadre). However, in the notification, the educational qualification is mentioned as Master Degree in Computer Application / Master Degree in Computer Science or Master Degree in Information Technology and B.Ed. Hence, the petitioners could not apply to the said Post. Therefore, the petitioners are here before this Court with the above said prayer. 3.The learned Counsel for the petitioners contended that the degree in M.Sc., (Computer Science and Information Technology) is equivalent to that of MSc.,(Computer Applications), M.Sc., ( Computer Science or Information Technology) and the syllabus are one and the same. Hence, they prayed for necessary directions to the respondents.

4.This Court, considering the grievances expressed by the petitioners, by a common order dated 24.04.2019 in WMP(MD)Nos.7151 to 7266, 7364 to 7403 and 7514 to 7519 of 2019 in WP(MD)Nos.9185 to 9242, 9363 to 9382 and 9548 to 9550 of 2019, passed the following interim order:

"Heard the learned Counsel on either side.

2.The learned Counsel for the petitioners submitted that the Teachers Recruitment Board has come forward to accept the applications of the petitioners in WP(MD) Nos.6654 and 7918 of 2019 on or before 26.04.2019, and in this regard a communication dated 16.04.2019 in Na.Ka.No.8019/R4/2017 issued by the Teachers Recruitment Board has also been submitted before this Court. Hence, the learned Counsel prayed that the petitioners in the present writ petitions may also be permitted to submit their applications on or before 26.04.2019.

3.The learned Special Government Pleader appearing for the 4th respondent has no serious objection in granting such relief to the petitioners.

4.In view of the above submissions made on either side, the petitioners are permitted to submit their applications manually along with required fee on or before 26.04.2019 by 5.00 pm."

5. The learned Counsel appearing for the respective respondents submitted that in view of the aforesaid interim order, the Equivalence Committee shall be directed to consider the grievances of the petitioners and based on their decision, the petitioners applications shall be processed further.

6. Having regard to the submissions made on either side, the Equivalence Committee is directed to consider the claim of the petitioners and issue necessary certificates, if the petitioners are otherwise found eligible. Such an exercise shall be competed, within a period of four weeks from the date of receipt of a copy of this order. If the Equivalence Committee decides the claim of the petitioners in their favour, the selection process may go on. If the claim of the petitioners are rejected, they shall not claim any equity on those lines and the respondents shall proceed in accordance with law.

7.These writ petitions are disposed of, on the above terms. No costs. Consequently, connected miscellaneous petitions are closed.
