ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 506(i) I.P.C., seeks anticipatory bail. 2.The petitioner is figuring as Accused No.2 in C.C.No.52 of 2017 on the file of the Judicial Magistrate Court IV, Tirunelveli. On account of his absence, Non-Bailable Warrant came to be issued. 3.The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

4.If the petitioner fails to appear before the Court below for future hearings, he is entitled to file appropriate petition under Section 317 Cr.P.C. Even if on one hearing, he is absent and no application is filed for condoning his absence, this order granting anticipatory bail shall stand cancelled.

5.Recording the abovesaid undertaking, the petitioner is directed to appear before the concerned Judicial Magistrate on next hearing date and to file a recall warrant petition, on such application being filed, the Learned Judicial Magistrate shall recall the warrant on the same day.
