: Respondents Prayer: The Writ Petition is filed under Art 226 Constitution of India to issue a Writ of Mandamus, directing the Respondents 3 and 4 to return the original certificates of the Petitioner viz., SSLC Certificate, CRRI Completion Certificate, MBBS Degree Certificate, MBBS TCMC Registration Certificate, MBBS Mark Sheets along with the Degree Certificate of Diploma in Anesthesiology, Attempt Certificate, MCI Recognition Certificate, Consolidated Mark Sheet, Conduct Certificate, Transfer Certificate and Migration Certificate for the purpose of admission into DNB PG Speciality 1/3

Course in Anesthesiology through All India Counselling to be conducted by the 5th Respondent by considering the Petitioner's representation dated 31.01.2020.

O R D E R

When the matter was taken up for hearing through Video Conferencing, it was pointed that for the same relief sought, the Petitioner had filed W.P. No. 23874 of 2018 along with certain others before the Principal Seat of this Court and though it has been disposed by order dated 01.10.2018, the Appeal in W.A. No.799 of 2019 is pending and as such the Petitioner cannot prosecute this Writ Petition and would have to work out her remedy by filing an application for any interim relief, if necessary, only in that appeal. In view of the same, Learned Counsel for the Petitioner has sought permission of this Court to withdraw the Writ Petition with liberty to resort to the aforesaid procedure and he has sent an e-mail dated 07.05.2020 confirming the same, which is placed on record.

2. Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty.

Consequently, connected Miscellaneous Petition is closed. No costs.
