This Writ Petition is filed for a Mandamus to direct the second respondent to issue patta to the petitioner in respect of Survey No.1330 to an extent 1 Acres 60 cents, Survey No.1355 to an extent of 92 cents, Survey No.1345 to an extent of 85 cents and Survey No.2378 to an extent of 39 cents, situated at Thimmarasanayakanur Village, Andipatty Taluk, Theni District, based on petitioner's representation dated 18.12.2025.
2. The learned counsel for the petitioner submits that the petitioner's son has made an online application to issue patta in the name of the petitioner. However, the respondents have rejected the same stating that the property is in the name of the petitioner. Subsequently, the petitioner was made a manual application, but the same was rejected stating that only online application is permitted. Hence, this writ petition.
3. In view of the above submissions, the petitioner is directed to submit a fresh online application in petitioner's name. Thereafter, the 2/4
second respondent shall survey the land as per the partition deed dated 31.01.2022, especially, the properties mentioned in schedule 'C' and schedule 'E', within a period of twelve (12) weeks from the date of receipt of an application. Notice may be issued to the petitioner as well as the rival parties stated in the partition deed before conducting survey. The survey may be conducted for the entire property, which is described in the said schedule and boundaries may be marked. As far as the separation of property is concerned, the parties are at liberty to follow the partition deed strictly.
