PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the Additional District Munsif cum Judicial Magistrate Court, Manamadurai to dispose C.C.No.59/2001 in Cr.No.369/1998 within stipulated time.

ORDER

This petition has been filed seeking a direction to the Additional District Munsif cum Judicial Magistrate Court, Manamadurai to dispose of C.C.No.59/2001 in Cr.No.369/1998 within stipulated time.

2.According to the learned counsel appearing for the petitioner, his case has been registered in Crime No.369 of 1998 under Section 379 IPC and subsequently, the same was taken on file in C.C.No.59 of 2001 on the file of the Additional District Munsif cum Judicial Magistrate Court, Manamadurai. But the aforesaid case is pending for more than 17 years. Hence, he filed the present Criminal Original Petition with the aforesaid prayer. 3.Considering the facts and circumstances of the case that the case is pending for more than 17 years, without going into the merits of the case, this Court is inclined to direct the learned Additional District Munsif cum Judicial Magistrate, Manamadurai, to dispose of the case in C.C.No.59 of 2001 as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order, if there is no other legal impediments.

4.This Criminal Original Petition is disposed of with the above direction.
