ORDER

The petitioner had studied Diploma in General Nursing and Midwifery and she was registered with the Tamil Nadu Nurses Midwives Council. She also appeared for MRB Staff Nurse Examination conducted by the 2nd respondent in the year 2019 and secured 57.50 marks. Based on merit and communal roster, the first respondent has issued appointment order dated 11.06.2020 appointing the petitioner as Nurse on adhoc basis for Covid-19. According to the petitioner, she was not permitted to join the duty. Therefore, she has approached this Court seeking a writ of mandamus directing the respondents to appoint her pursuant to the earlier order dated 11.06.2020.

2. Mr.C.Venkatesh Kumar, learned Special Government Pleader, takes notice for the respondents 1 and 2 and submits that the petitioner has been engaged only on adhoc basis for a period of six months. But, 2/5

the petitioner has not joined the duty at that time and has not made any request for permitting her to join the duty. He further submits that the allegation made by the petitioner that she has not been permitted to join duty, is baseless. According to him, the petitioner was not prepared to join the duty as per the earlier appointment order and now, she wants to take advantage of the earlier appointment order and also filed this writ petition seeking a Writ of Mandamus.

3. This Court considered the rival submissions made.

4. The petitioner seeks appointment based on the earlier appointment order dated 11.06.2020. The earlier appointment order itself has been passed on adhoc basis for a period of six months from the date of appointment. Since the petitioner has not availed the opportunity, she is not entitled for the relief as sought for in this writ petition. However, the petitioner can be considered sympathetically in any of the temporary vacancies in the Government Hospital. The petitioner shall make a request to the first respondent within a period of four weeks from the date of receipt of a copy of this order and the first respondent shall 3/5

consider the case of the petitioner sympathetically.
