This petition is filed for issuance of a direction, directing the learned Chief Judicial Magistrate, Madurai to expedite the trial in C.C.No.2 of 2015 within a time frame.
2.The learned counsel for the petitioner is present. Mr.Rajkumar, Special Public Prosecutor takes notice for the respondent.
3.Heard both sides.
4.It is an admitted fact that the petitioner herein is the de facto complainant in C.C.No.2 of 2015, which is pending before the learned Chief Judicial Magistrate, Madurai. There are 4 accused in this case and all the accused are appearing before the Trial Court and charges are yet to be framed in this case. It is also admitted that the accused namely, P.Nagamanickam filed a petition under Section 239 Cr.P.C. in Crl.M.P.No.541 of 2015 for discharging him from the charges levelled against him.
5.The learned Special Public Prosecutor appearing for the respondent has submitted that the respondent has filed counter in the discharge application and the same is pending for disposal. https://hcservices.ecourts.gov.in/hcservices/
6.Considering the facts and circumstances of the case, this Court is inclined to give a direction to the Trial Court. Accordingly, the learned Chief Judicial Magistrate, Madurai is hereby directed to dispose of the discharge petition in Crl.M.P.No.514 of 2015 within a period of two months from the date of receipt of a copy of this order and conclude the trial as early as possible.
