PRAYER :- For Bail in Cr No.80/2022 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 22.12.2022 for the offence punishable under Sections 5(m),5(n)r/w.Section6,17 and section 3(a) r/w.Section 4 of POCSO Act in crime No.80 of 2022 on the file of the respondent police, seeks bail.
2.The defacto complainant was married to one Renuha and out of the wedlock they were blessed with two female children. The case of the prosecution is that due to some family dispute, the wife of the defacto complainant had approached the petitioner for solving the family which leads his wife to have illegal relationship with the petitioner. Both the wife of the defacto complainant and the petitioner sexually abused the children, hence the case.
3. Heard both sides and perused the materials available on record including the First Information Report and also the statement of the victim recorded under section 164 of Cr.P.C.
4. It is seen that the petitioner and A2 had illegal intimacy. That apart the petitioner is a bogus god man and he utilizing the said circumstances had committed penetrative sexual assault on the two victim children aged about 8 years and 10 years and he has https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.5160 of 2023 committed a very serious and heinous offence as against the minor victim girls, hence this Court is not inclined to grant bail to the petitioner.
5. Hence the petition stands dismissed.
