PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the respondents to register the case on the complaint given by the petitioner on 29.09.2022 and to investigate the matter within the time stipulated by this Court.

O R D E R

The Criminal Original Petition has been filed to direct the respondents to register the case on the complaint given by the petitioner on 29.09.2022 and to investigate the matter within the time stipulated by this Court.

2. On the basis of the order that has been passed by the learned Judicial Magistrate No.II, Ramanathapuram, in Crl.M.P. No.7207/2022 dated 04.01.2023, this petition has been filed. Since, already there is a direction by the Competent Criminal Court, the second direction may not be proper and requires also.

3. The learned Additional Public Prosecutor would submit that on the basis of the above said complaint given by the petitioner, enquiry was undertaken. During the course of the enquiry, it was found that it is a civil transaction between the parties. Based on which, further action was dropped by the report dated 04.02.2023.

4.The learned counsel for the petitioner would submit that the above said report itself is not proper and legal also.

5. If the petitioner wants to agitate the above said closure report, he can agitate the same before the concerned Court, which passed the order. This Court cannot interfere into the same at this stage. The second respondent is directed to file the above said closure report before the concerned Court within a week from the date of receipt of copy of this order.

6. With the above said liberty, this Criminal Original Petition is disposed of.
