ORDER : The Court made the following order :- This petition for bail sought by the first accused on the ground that the petitioner is in prison for the past 72 days for the alleged offence under Sections 406 and 420 of IPC. Hence, he may be considered for release of bail under Section 167(2) of Cr.P.C. 2.The learned Additional Public Prosecutor opposed to grant bail to the petitioner on the ground that the petitioner along with A-2 has cheated the de-facto complainant and others to the tune of Rs.17,00,000/- promising them to get job abroad. Due to lock down, the investigating agency is not able to complete the investigation and file final report.

CRL OP(MD). No.5308 of 2020 3.From the First Information Report, this Court finds that the petitioner and the absconding accused have enticed the de-facto complainant family to part away huge sum of money on promise to secure job abroad. The petitioner herein was arrested. Based on the confession statement two gold rings and Rs.20,000/- has been recovered which are to be considered as part of the crime proceedings. Since the remaining amount could not be traced and recovered, due to lock down this Court finds that this not appropriate stage to grant bail to the petitioner. Hence, the Criminal Original Petition stands dismissed.
