PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents No.2 and 3 to survey and demarcate petitioner landed properties Survey No.43/7G1, 43/7G2 and 47/8B to total extent 3 Acre 54 cents the property situated at Poruppumettupatti Village, Usilampatti Taluk, Madurai District on the basis of the petitioner's representation 11.10.2025 dated after given necessary opportunity to the parties concerned within time frame as fixed by this Court and for other reliefs. O R D E R

This petition has been filed seeking to direct the respondents No.2 and 3 to survey and demarcate petitioner's landed properties in Survey No. 43/7G1, 43/7G2 and 47/8B to total extent 3 Acre 54 cents based on the petitioner's representation dated 11.10.2025. 2/7

2. The learned counsel for the petitioner submitted that the petitioner had purchased a portion of the property from the 5th respondent under a sale deed dated 05.05.2025. However, the vendor (5th respondent) is presently disputing the sale in respect of another portion of the property, while not raising any claim over the portion purchased by the petitioner. It was further submitted that the 5th respondent had earlier filed a suit in O.S. No. 85 of 2024 against the petitioner and two others, which was subsequently dismissed for default. In these circumstances, the petitioner seeks to have the property surveyed and properly demarcated.

3. Heard the learned Additional Government Pleader appearing for the respondents 1 to 3 and the learned Government Advocate (Criminal Side) appearing for the 4th respondent.

4. Considering the facts and circumstances of the case, this Court directs the 2nd respondent to conduct the survey based on the sale deed dated 05.05.2025 after issuing notice to both the petitioner and the 5th respondent. if necessary, 3/7

seek police protection, the 4th respondent shall provide police protection to survey the land. The Court is also directing the second respondent to adhere to the following Standard Operating Procedures:

a. The second respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b.After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 4/7

The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
