ORDER

This Criminal Original Petition has been filed to direct the second respondent not to interfere the civil dispute between the petitioner and the third respondent and not to harass the petitioner under the guise of enquiry.

2. According to the petitioner, there is a civil dispute pending between the parties in respect of execution of building contract work and the petitioner is the contractor and he entered into agreement with the third respondent for construction of building and thereafter, due to misunderstanding, after completion of major portion of work, the third respondent engaged another contractor and completed the construction work and house warming ceremony also conducted in the year 2021. Now the third respondent lodged a complaint alleging that the petitioner has to pay a sum of Rs.10,00,000/- and based on the said complaint, the second respondent frequently called the petitioner for the money dispute. Therefore, the petitioner filed this petition.

3. The learned Government Advocate (Crl. Side) appearing for the official respondents would submit that based on the complaint given by the 2/5

third respondent as against the petitioner, they conducted enquiry and thereafter, the same was closed by advising the parties to approach the civil Court since the matter is pertaining to civil dispute and the second respondent has not harassed the petitioner as alleged by him.

4. Since the prayer of the petitioner is to direct the second respondent not to interfere the civil dispute and already enquiry was conducted and closed, nothing survives for further adjudication in the present case.

5. In view of the same and recording the above said submission of the learned Government Advocate (Crl.
