O R D E R

This Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, to direct the Chief Judicial Magistrate No.1, Tirunelveli, to dispose of the complaint in C.C.No.195 of 2012 within the time frame fixed by this Court.

2. Heard the learned counsel for the petitioner and perused the records.

3. On perusal of the Diary extract, it is seen that the accused was not made any single appearance and the petition filed under Section 317 Cr.P.C. is adjourned on every occasion without any valuable reason.

4. In connection with the delay, a report was called for from the learned Judicial Magistrate No.I, Tirunelveli. In his report, he has stated that some progress has been shown in the trial. It was stated in the report that the delay in production of documents in Crl.M.P.No.278 of 2015 and 5152 of 2014 are the cause for the delay in disposal of the above case. It appears that the accused, namely, the respondent is trying to protract the proceedings.

5. Having regard to the limited scope of the proceedings, this Court is of the view that the proceedings may be disposed of as early as possible. Hence, the learned Chief Judicial Magistrate No.I, Tirunelveli is directed to dispose of the case in C.C.No.194 https://hcservices.ecourts.gov.in/hcservices/

of 2012 within a period of three months from the date of receipt of the copy of this order.

6. With the above direction, this Criminal Original Petition is disposed of.
