For Respondent : Mr.S.Chandrasekar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 468 of 2020 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

2.The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 4(1) (aaa), 4(1)(g) and 4(1-A) of the Tamilnadu Prohibition Act in Crime No.468 of 2020 on the file of the respondent police, seek anticipatory bail.

CRL OP(MD). No.5353 of 2020 3.According to the prosecution, on 25.04.2020, based on the information, the respondent police has raided the place of the petitioners and found six persons indulging in brewing illicit liquor. Totally 130 liters of illicit liquor has been seized and disposed.

4.The learned Additional Public Prosecutor strongly opposed the grant of anticipatory bail to the petitioner stating that during lock-down Covid perid, TASMAC shops were closed and taking advantage of this situation, the petitioners and other accused were brewing illicit liquor. the nature of the liquor brewing by the petitioners has to be tested in the laboratory.

5.In the said facts and circumstances, this Court is of the view that the petitioners has to be arrested and interrogated.
